These terms and conditions refer to the following these additional items, which also apply to your use of our site and are hereby deemed incorporated in these terms and conditions. In the event of any conflict between these terms and conditions and anything contained elsewhere in the site, these terms and conditions take precedence;

• Our Cookie Policy, which sets out information about the cookies on our site.

Information you give us. This Is Information about you that you give us by filling in forms on our site, participating in voluntary surveys or by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to use our site, subscribe to our service, access an application on our site, access our web portal and when you report a problem with our site. The information you give us may include your name, address, e-mail address, phone number, or the account details associated with your application or web portal account.

Information we collect about you. We collect demographic information such as your general area postcode, IP addresses related to our portal software access, and IP addresses related to the measurable.energy Plug Sockets devices you use as part of the services we provide where our devices are installed in premises that you use or where you are located.

In addition, with regard to each of your visits to our site we will automatically collect the following information:

• Technical information, Including the internet protocol (IP) address used to connect your computer to the internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, log in time and referring website addresses.

• Information about your visit, including the full Uniform Resource Locators (URL), clickstream to, through and from our site (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse overs), methods used to browse away from the page, and any phone number used to call us.

Information we receive from other sources

This is information we receive about you If you use any of the other websites we operate or the other services we provide. We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies).

Special Category Data

We do not collect special category data such as biometric data for unique identification, health Information and medical records, criminal records, racial or ethnic origin, political orientation or beliefs, religious or philosophical beliefs, trade union membership, data concerning sex life or sexual orientation, genetic data, not do we require you to give us this data.

Information about other individuals

If you give us information on behalf of someone else, you confirm that the other person has appointed you to act on his/her behalf and has agreed that you can: 

• give consent on his/her behalf to the processing of his/her personal data;

• receive on his/her behalf any data protection notices; and

• give consent to the transfer of his/her personal as contemplated in this privacy policy.

Information about us

Measurable Limited ("We"). We are a private limited company registered in England and Wales under company number 11403660 with our registered office at Fountain House - 8th Floor, 2 Queens Walk, Reading, Berkshire, England, RG1 7QF.  Our VAT number is 323 3856 09. We provide a service to measure and manage energy consumption using devices connected to electrical energy sources and the internet. 

Changes to these terms 

We may revise these terms and conditions at any time by amending this page. Where appropriate and possible, we shall endeavour to notify visitors to our site that the terms and conditions have been revised but cannot undertake to do so each time. Please check this page from time to time to be aware of any changes we make, as they are binding on you with immediate effect.

Changes to our site

We may update our site from time to time and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, web portal, any content, or any applications available on it, will be free from errors or omissions. 

Accessing our site

Our site is made available free of charge. We do not guarantee that our site, web portal, applications, or any content within, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.  

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and conditions and all other applicable terms on the site, and that they comply with them.

Our site is primarily directed at energy consumers in the United Kingdom and in the European Union although, if you are outside the United Kingdom or the European Union there is nothing to stop you visiting our site. We and our site comply with all applicable legislation in the United Kingdom.

Access to the applications on our site

In order to access and make use of the application made available via our site or web portal, you or someone who has authorised you to use the applications will need to have subscribed to our service (details of which can be viewed on our site or by contacting info@measurable.energy).

Use of the applications and web portal is subject to the terms of a master service agreement with the subscriber to the services as well as to the Acceptable Use Policy.  You are responsible for complying with the Acceptable Use Policy if you access our applications, website or web portal.

Your account and password 

If you choose, or you are provided with a password or any other piece of information as part of our security procedures to access any part of our site and web portal or our services (including the applications on our site), you must treat such information as confidential and must not disclose it to any third party. If you know our suspect that anyone other than you knows your password, you must promptly notify us at security@measurable.energy.

Intellectual property rights

We are the owner of the licensee of all intellectual property rights in our site, web portal, material published within them, and in our applications.  Those works are protected by copyright laws around the world. All such rights are reserved. 

You may print off copies, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged in any use you make of such content. You must not use any part of the content on our site for commercial purpose without first obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms and conditions, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. You may not access or use the web portal or any applications available via our site unless you are an authorised user (i.e. you or someone else that has given you authorisation has subscribed to our service). 

No reliance of information

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from any action on the basis of the content on our site. Although we make reasonable efforts to ensure that the content on our site is useful and appropriate and to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is correct, accurate, complete, or up to date.

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by the laws of England and Wales.  To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms which may apply to our site or any content on it, whether express or implied.  

We will not be liable to any user of our site for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

• use of or reliance on any content displayed on our site. 

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it. 

We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them. Our liability for any loss or damage arising out of access to or use of the applications made available via our site or web portal is governed by the master services agreement entered into between us and the subscriber to the services.  

Viruses

We do not guarantee that our site will be secure or free from bugs and viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored, or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
